Employment Law
Employment Agreements
An employment agreement is like a blueprint to the employment relationship. It sets out the parameters, entitlements, obligations and restrictions in a relationship between an employer and an employee.
Areas Covered by An Employment Agreement
An employment agreement will dictate entitlements, and obligations in the following areas:
- Salary and bonuses
- Group health benefits
- Equity incentives such as stock options, restricted stock, and RSUs
- Other fringe benefits such as employee discounts, gym memberships, company vehicle and car allowances
- Termination packages including required notice
- Restrictive covenants such as non-competition and non-solicitation clauses, which restrict an employee’s post-termination activities
- Confidentiality intellectual property
Items That Might Render An Employment Contract Invalid
For an employment contract to be considered valid it must meet certain basic conditions:
- Offer and acceptance – both parties must come to a common understanding of the terms of employment
- The terms of the contract must not be considered unconscionable or illegal
- There must be “consideration” for entering into the contract
